Terms of Service
Last updated: [Date]
These Terms of Service ("Terms") govern your use of ComplyScan (the "Service"), operated by [Company Legal Name] ("we," "us," or "our"). By creating an account, submitting a URL to be scanned, or otherwise using the Service, you agree to these Terms.
1. What the Service Does
ComplyScan runs automated technical tests (via the open-source axe-core engine) against web pages you submit, and may use AI (currently Anthropic's Claude models) to generate plain-English explanations and suggested code fixes for issues found. Scan results and AI-generated content are provided "as is" and may contain errors or omissions — see Section 7 (Disclaimers).
2. Accounts
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating an account and keep your email address current, since we use it for account notices and scan digests.
3. Subscriptions and Billing
Paid plans are billed in advance on a recurring basis through Stripe. You can cancel anytime from the billing portal linked in your dashboard; cancellation takes effect at the end of the current billing period, and we do not provide refunds for partial periods except where required by law. We may change our pricing with notice; changes apply to your next billing cycle, not retroactively.
4. Acceptable Use
You agree not to:
- Submit URLs for websites you do not own or have authorization to test
- Use the Service to send unsolicited bulk email or otherwise abuse the outbound features
- Attempt to circumvent rate limits, scan quotas, or other technical restrictions
- Use the Service to build a directly competing product by systematically extracting our AI-generated content
- Interfere with or disrupt the Service's infrastructure
5. Intellectual Property
We retain all rights to the Service itself. You retain ownership of your own website content; scan reports and AI-generated explanations and fixes generated for your account are yours to use for your own compliance purposes.
6. Not Legal Advice
ComplyScan performs technical WCAG conformance testing. It is not legal advice, does not constitute a certification of compliance with the European Accessibility Act or any other law, and should not be relied on as a substitute for advice from a qualified lawyer. Automated testing tools, including this one, cannot detect every accessibility issue — human review remains necessary for full WCAG conformance.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI-GENERATED CONTENT (EXPLANATIONS AND SUGGESTED CODE FIXES) MAY BE INACCURATE OR INCOMPLETE AND SHOULD BE REVIEWED BEFORE USE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY LEGAL NAME] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON SCAN RESULTS OR AI-GENERATED CONTENT FOR REGULATORY, LEGAL, OR COMPLIANCE PURPOSES. [This section needs jurisdiction-specific legal review — some jurisdictions do not allow these exclusions.]
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms, including the Acceptable Use section above. You may stop using the Service and cancel your subscription at any time.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or an in-app notice before they take effect.
11. Governing Law
These Terms are governed by the laws of [Jurisdiction], without regard to conflict-of-law principles.
